Meet Dale Fout and Brenda Godwin. One weekday in April, they both went to a movie theater in Grapevine. Sat a row apart. Didn't know each other.
By coincidence, they were born in the same year, two days apart. Both are 54. Fout, a marketing consultant, describes himself as a 220-pound "pretty big guy. I'm broad. I'm not fat. Used to play football." Godwin says she is a 136-pound skin care specialist. Here's how they met in the theater.
Her side
"He had his phone out. The light was shining at me. I'm thinking, 'He's going to turn it off.'" But he didn't. 'OK, this is ridiculous.' So I reached over and tapped him on the shoulder. It was very bright. I was only trying to get his attention. He whipped around and said, 'Don't ever touch me.' I was a little taken aback. 'I wouldn't have touched you if you didn't have your phone out.'
"He jumps up and whirls around towards me and says, 'I am charging you with assault,' and he flew out of the theater."
His side
"I got a text, and I responded to it because it was something important. It was something that was on a deadline situation, OK. I held it against my chest purposely where I could barely see it. ... I could text but hide the majority of the light coming from the phone.
"She said something. I couldn't make it out. That's why I turned. She was probably saying something like, 'Get off your phone.' I turned, and she pushed. She just happened to push my neck at the time my neck was in an awkward position. Kinda like having a little fender bender, and you get a little whiplash in your neck, you know."
Police report
"Fout advised he had been assaulted and his neck was in pain," officer Emily Hays wrote. Fout was treated for neck pain by Grapevine paramedics. "Fout said a female who was sitting behind him in Theater 8 grabbed him by the shoulder because he was texting during the movie," Hays wrote. "Fout said he got up, walked out of the theater and asked management to call police."
Godwin told police, Hays wrote, that "she tapped him on the shoulder with one finger to ask him to stop texting. Godwin advised the male then jumped out of his chair and ran outside of the theater.
"Fout stated he was offended by the contact and desires prosecution. Godwin was issued citation #P0039176 for assault by contact."
Police comment
"We're the middle person on this," Lt. Todd Dearing says. "Assault by contact is usually not something like this. It's usually a shove." Because police didn't witness the incident, a ticket was written. It's a misdemeanor, the equivalent of a traffic ticket. "We stay neutral in these things. That's what the courts are for."
The legal side
The common thinking is that in Texas, unwanted touching can justify an assault charge. That's true, but there are requirements.
The law says: "A person commits an offense if the person ... intentionally or knowingly causes physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative."
Jeff Bellin, SMU assistant professor of law, says that a tap is not an assault but that a shove may be.
"It would be a jury question, but I think most people would agree that tapping someone on the shoulder, even if you don't know them, is normal. We expect that kind of interaction in our everyday lives."
A jury would have to decide which person to believe. Fout's injury would be key. He says his neck hurts "a little bit. I'm seeing a chiropractor. It's not like she knocked me to the floor. ... The therapist said, 'Yeah, she put a knot right there.' A tap on the shoulder isn't going to cause that."
Godwin says, "If he hurt his neck, that's probably because of the way he whipped around."
Because Godwin lives in Richmond, Va., she said it would be too expensive to return and fight the charge. So she paid a $260 fine.
What should you do?
The incident occurred at Cinemark Tinseltown, whose policy is to give texters a chance to behave. If they don't, they are removed and given a refund or a rain check.
"If they are texting, we ask them to return to the theater at a time when they are less busy and can enjoy the movie," Cinemark spokesman James Meredith says.
Watchdog tip: Although Cinemark says it sends employees into each theater every 20-30 minutes to check behavior, why wait? Go outside and talk to a staffer about the problem. Let that person do the deed.

LOL filing assault for a tap on the shoulder? He should have been pepper sprayed after giving the report and fined for taking up the time of the officers.

Report: Black ‘Mobs’ Attack White Patrons Outside Wis. State Fair
“It looked like they were just going after white guys, white people.”
That’s how Norb Roffers described the scene outside the Wisconsin State Fair on Thursday night to Newsradio 620 WTMJ in Milwaukee. “They were attacking everybody for no reason whatsoever,” he added.
Roffers and others painted a grim and detailed picture of what unfolded during the first day of the fair.
“It was 100% racial,” claimed Eric, an Iraq war veteran who told the station that young people beat on his car.
WTMJ sums up their accounts: “Witnesses’ accounts claim everything from dozens to hundreds of young black people beating white people as they left State Fair Thursday night.”
Milwaukee Police confirmed to WTMJ that officers responded to “complaints of battery, fighting and property damage due to a large, unruly crowd.”
However, since reports of injuries were still coming in, police could not give a detailed account of what happened.
Here is just some of what the witnesses claim to have experienced:
“I had a black couple on my right side, and these black kids were running in between all the cars, and they were pounding on my doors and trying to open up doors on my car, and they didn’t do one thing to this black couple that was in this car next to us. They just kept walking right past their car. They were looking in everybody’s windshield as they were running by, seeing who was white and who was black. Guarantee it.”

“That rated right up there with it. When I saw the amount of kids coming down the road, all I kept thinking was, ‘There’s not enough cops to handle this.‘ There’s no way. It would have taken the National Guard to control the number of kids that were coming off the road. They were knocking people off their motorcycles.”

“As we got closer to the street, we looked up the road, and we saw a quite a bit of commotion going on and there was a guy laying in the road, and nobody was even laying there. He wasn’t even moving. Finally a car pulled up. They stopped right next to the guy, and it looked like someone was going to help him. We were kind of stuck, because we couldn’t cross. Traffic was going through. Young black men running around, beating on people, and we were like ‘Let’s get the heck out of here.’ The light turned, and I got attacked from behind. I just got hit in the back of the head real hard. I’m like, ‘What the heck is going on here?’ I heard my bell ring.”
Roffers further described what witnesses said happened to the man who was lying in the street.
“People were saying he was on a bike. They tore him off his bike and beat on him. We were walking to the west on Schlinger. I was watching behind me a lot more diligently, making sure there wasn’t anybody coming to get us anymore.”

“I saw them grab this wide kid who was probably 14 or 15 years old. They just flung him into the road. They just jumped on him and started beating him. They were kicking him. He was on the ground. A girl picked up a construction sign and pushed it over on top of him. They were just running by and kicking him in the face.”
Then, Eric talked about trying to get out of the car to help the victim.
“My wife pulled me back in because she didn’t want me to get hit. Thankfully, there was surprising a lady that was in the car in front of me that jumped out of the car real quick and went over there to try to put her body around the kid so they couldn’t see he was laying there and, obviously, defenseless. Her husband, or whoever was in the car, was screaming at her to get back into the car. She ended up going back into the car. These black kids grabbed this kid off the ground again, and pulled him up over the curb, onto the sidewalk and threw him into the bushes like he was a piece of garbage.”
Eric claimed that the victim in that beating was by himself, and that there was a split of white people on one sidewalk and black people on the other.
“There was nobody else around to help him. There were no other white people, period, on that side of the street. They were going in the opposite direction because, those people who were coming out of the fair that saw these people coming, they either went back into the fair or took off running south on 84th Street.”

“The thing that irritated me, the State Fair Police, the State Police, were down by the Pettit entrance to get in there,” said Eric. “There was probably 5 or 6 officers down there. That’s where all these kids came from. They came out of the Midway, across the front of the Pettit. They were still filing out of there. The State Fair Police, they knew this was going on. They knew these kids were beating these guys in between that exit and Schlinger at the next gate.”
“They were stopping traffic, and I said ‘What in the hell,’ excuse my language, ‘what are you guys doing directing traffic when there are 300, 400 black kids up the road beating the hell out of everybody, pushing people off of motorcycles?’ I was livid. I could not believe they were directing traffic.”

No, the conference isn't pushing for more consistent penalties for programs guilty of major violations or a later early entry decision date for potential NBA draft prospects. The Big East simply wants to ensure its student-athletes no longer have to endure post-workout dry mouth as a result of eating complimentary bagels with no spread.
Proposal No. 2011-78 would permit institutions to offer spreads such as "butter, peanut butter, jelly and cream cheese" with bagels they already may provide to student-athletes at any time. It's by far the most inane of the 91 potential rule changes the NCAA legislative council will have to consider next January.
Believe it or not, current NCAA legislation enacted in 2009 only allows schools to provide bagels, fruits and nuts to student-athletes, which means that a complimentary butter or jam packet would be a minor violation. Schools couldn't provide athletes any food except energy bars prior to that rule change.
That the legislative council will spend even a few minutes haggling over cream cheese at a time when there are so many more serious problems facing college athletics is a sign that the NCAA's priorities remain out of whack. It's laughable enough to inspire amateur comedians on Twitter to poke fun at the NCAA's expense yet again on Monday, calling the potential relaxing of anti-bagel spread rules the end of "our long national nightmare" and jokingly asking if Nutella would still be impermissible.
In the NCAA's defense, one of Monday's proposed rule changes was compassionate and long overdue: Proposal 2011-79 would allow an institution to pay expenses for the entire team to be with a teammate after a death or life-threatening incident.
It's such a common sense amendment that it probably shouldn't even need to be in the rule book, but the NCAA's track record suggests logic can't always be taken for granted.
The babysitter accused of placing a baby in a stroller in the back of a pickup truck says the child was not in any danger.
Keyona Nichole Davis, 23, was charged with child neglect, and released from jail Thursday evening.
According to Daytona Beach police, Davis was watching 8-month-old Terrence McClain, when she put the boy in his stroller in the bed of a 1994 Dodge Ram pickup.
Police said Davis also rode in the back of the pickup with the baby as the driver, identified as "Mr. B. White" in officers' arrest report for Davis, started driving through the city.
Officers later spotted the pickup driving on a busy road, with the stroller still in the back. Several other drivers also called 911. Police caught up with the truck and arrested Davis, and cited the driver for careless driving.
The baby was unharmed, but the prosecutor said he could have easily been injured or killed.
"A child, if seated in a car and not strapped in a car seat, that's a crime," said Assistant State Attorney Reginald Moore.
Davis' public defender said the felony child neglect charge against she is too severe. Davis said she didn't know it would be child neglect.
"I got my first child when I was 16," Davis said during the hearing. "It's not like they give you a handbook on what's neglect, what's not neglect."
When officers contacted the boy's mother, they said she was in tears as she was told about the incident. She later arrived to pick up her son.
According to the Volusia County Corrections Department's database, Davis was also arrested for disorderly conduct less than two weeks earlier.

One-time UFC lovable loser Joseph Hyungmin Son has been convicted of torture after DNA evidence tied him to a brutal gang rape that took place in 1990.
Son (0-4), also known to non-MMA fans as "Random Task" from Austin Powers: International Man of Mystery, is probably best known in the fight community for having his balls demolished by Keith Hackney back at UFC 4 en route to a first round submission loss.
After pleading guilty to felony vandalism in May of 2008, Son was required to submit a DNA sample as part of his guilty plea. That sample connected him to an unsolved gang rape that took place over 18 years ago.
According to the Orange County District Attorney’s Office, the victim was pistol-whipped, raped, threatened with death and penetrated by a firearm before eventually being blindfolded and released naked.

[Son] was initially charged with multiple sexual assault charges and faced a maximum sentence of 275 years to life in prison. However, many of those charges were dropped because the statute of limitations had expired.
A co-defendant in the case pleaded guilty to rape, kidnapping and other charges, and was sentenced to 17 years in and four months in prison.
Son will be sentenced on Sept. 17 and is facing a maximum penalty of 15 years to life.

Jessica Callaway Had Trouble Deciding on Outfit Friday Night -- So She Beat Her Infant Daughter Before Blowing Weed Smoke in Her Mouth
Jessica Callaway was having a hard time picking out an outfit Friday night -- so she beat her 10-month-old daughter and blew weed smoke in her face to get her to stop crying.
Jessica Callaway, 21, was caught on video Friday telling her 10-month-old baby to "shut the fuck up before I kick you in the mouth" as the infant was laying on the floor of her Gilbert home. Then she hit the baby in the face several times, apparently to get the child to stop crying.
That was just one of Callaway's alleged methods of soothing her crying baby -- another of her tactics includes blowing weed smoke in the baby's mouth.
She later told police the reason she was so frustrated with the baby's crying was because she was "having a bad day," and "having trouble finding an outfit to wear out that night."
According to court documents obtained by New Times, on Friday night, Callaway was trying to get dressed to go out. As she was picking out an outfit, the baby was laying on the floor of her bedroom crying.
On video recorded by a friend, Callaway is seen walking into the room and immediately picking the baby up by her leg and spanking her. She then told the baby "shut the fuck up before I kick you in the mouth."
Then Callaway is seen hitting the baby in the face repeatedly.
That same day, Callaway and a friend were smoking pot in the same room as the baby. Her friend later told police that in order to get the infant to stop crying, Callaway blew some of the weed smoke directly in the baby's mouth.
The friend noted the baby seemed thirsty after ingesting some of the weed.
Callaway was interviewed by police on Saturday. She told detectives about her bad day, and difficulty picking out an outfit, which she says is why she hit the baby. She claims she didn't hit the baby hard enough to leave a mark, though.
Callaway admitted to blowing weed smoke in the baby's mouth, saying she did so in order to get the girl to stop crying.
Callaway was booked on three counts of child abuse. She was released from jail on $2,700 bond. He next court appearance is scheduled for Thursday.

I hope she is beaten to near death everyday until she take the cowards way out and kills herself....no she wishes she could kill herself but her limbs are never healed up enough to accomplish it. What ever allows her to suffer the most pain.
